Q1: What is an Enterprise Agreement (EA)?
An Enterprise Agreement sets out the terms and conditions of employment for staff and usually applies to a single employer. In order to be approved, an Enterprise Agreement requires a valid majority of staff to vote in favour of a draft agreement that has been negotiated with the relevant parties, prior to seeking certification of the agreement with the relevant authority.
A ‘valid majority’ is the majority of staff that have their terms and conditions covered by that agreement, who vote for or against the agreement.
Q2: What is the Workplace Relations Act?
The Workplace Relations Act 1996 provides a legislative framework for workplace relations matters for employers and employees in Australia, thereby providing the means to ensure that employment matters are dealt with at the enterprise level wherever possible.
Q3: What is the difference between an award and an enterprise agreement?
Unlike awards, which provide minimum standards and conditions of employment for employees in an entire industry, enterprise agreements usually apply only to one employer. The terms and conditions set out in an enterprise agreement override any corresponding provisions set out in any applicable award.
Q4: The University of Melbourne's enterprise agreement is closed and comprehensive. What does this mean?
A closed and comprehensive agreement operates to the exclusion of and replaces any award (existing or future), various legislative Acts, and any other previous enterprise agreements which may otherwise apply to staff employed at the University.
Q5: What consultation will the University have with staff about enterprise bargaining negotiations?
The University will consult with staff through a number of different communication options. These may include the HR website, Staff News, News Update e-newsletter, emails to University of Melbourne staff and through staff briefing sessions. Copies of relevant correspondence and information will appear on this website.
